Frequently asked questions

Straight answers to the questions we hear most.

Ask your own →
Is a written contract legally required?
Not always, but it's strongly recommended. Written terms avoid confusion and disputes.
Can a contract pay less than the award?
No. A contract can't provide less than the award or the National Employment Standards.
Do you write restraint of trade clauses?
We can include them, and recommend legal advice for senior roles where restraints are important.
What is a set-off clause?
A clause that lets an above-award salary cover certain award entitlements. It must be written and checked carefully.
Can you update existing contracts?
Yes. We review and update contracts, and help with the conversations about changes.
Do casual employees need a contract?
It's good practice, and employers must give casuals the Casual Employment Information Statement.
